Submission. The Committee notes the Government’s indication that a draft report on the Quality Apprenticeships Recommendation (No. 208), 2023, is being reviewed by the competent authorities before it can be submitted to the Parliament. Moreover, the Government reiterates that the possibility of ratifying the Occupational Safety and Health Convention, 1981 (No. 155), is being considered in connection with the Safe and Healthy Working Environment (Consequential Amendments) Convention (No. 191), and Recommendation (No. 207), 2023. The Government adds that the submission of Conventions Nos 155 and 191 and Recommendation No. 207 is being considered together with the Domestic Workers Convention (No. 189), and Recommendation (No. 201), 2011; the Transition from the Informal to the Formal Economy Recommendation (No. 204), 2015; and the Employment and Decent Work for Peace and Resilience Recommendation (No. 205), 2017.
In this regard, the Committee wishes to highlight that the completion of the submission process does not require a decision to ratify a Convention or Protocol. The Committee refers to the 2005 Memorandum concerning the obligation to submit Conventions and Recommendations to the competent authorities, where it is noted that the main aim of submission is to promote measures at the domestic level for the implementation of Conventions and Recommendations, as well as to promote ratification of Conventions. Governments remain entirely free to propose any action which they may judge appropriate in respect of ILO instruments. One purpose of this obligation is that the instruments adopted by the Conference are brought to the knowledge of the public through their submission to a parliamentary body (2005 Memorandum, Part I(a)–(c)). The Committee recalls once more that the constitutional obligation of submission is of the highest importance and is a fundamental element of the standards system of the ILO. The Committee therefore reiterates once again its request that the Government provide information on the submission to the National Council, including specifying the dates of submissions, of the following pending instruments adopted by the Conference at its 100th, 104th, 106th and 111th Sessions: the Domestic Workers Convention (No. 189), and Recommendation (No. 201), 2011; the Transition from the Informal to the Formal Economy Recommendation, 2015 (No. 204); and the Employment and Decent Work for Peace and Resilience Recommendation, 2017 (No. 205); the Safe and Healthy Working Environment (Consequential Amendments) Convention (No. 191) and Recommendation (No. 207), 2023 and the Quality Apprenticeships Recommendation, 2023 (No. 208).
